Welcome to Rent A Hubbly! These Terms of Service (“Terms”) govern your rental and use of equipment and services provided by Pine Street Capital Management (Pty) Ltd, trading as Rent A Hubbly. By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our services.

1. Definitions

• “Company”: Refers to Pine Street Capital Management (Pty) Ltd, trading as Rent A Hubbly.
• “Customer”: Refers to any individual or entity that places an order for equipment rental or services from Rent A Hubbly.
• “Order”: Any confirmed request made by the Customer for the rental of Equipment or services provided by Rent A Hubbly.
• “Equipment”: Includes hookah devices, hoses, mouthpieces, coal trays, tobacco flavors, and any other related accessories rented out by Rent A Hubbly.
• “Security Deposit”: A refundable amount required to cover potential loss, damage, or additional charges incurred during the rental period.
• “Event”: Any organized gathering such as parties, weddings, or corporate events where Equipment and services are provided.
• “Delivery”: Refers to the transportation of Equipment from the Company to the Customer’s specified address.

2. Eligibility and Age Restrictions

To use our services, you must be at least 18 years old and have the legal capacity to enter into binding agreements. By placing an Order, you confirm that you meet these eligibility requirements. Rent A Hubbly does not verify the age of its Customers. By using our website and services, you affirm that you are above the age of 18.

3. Scope of Services

Rent A Hubbly specializes in the rental of hookah devices and accessories exclusively through a delivery service. Customers do not have the option to pick up Equipment. The available products include, but are not limited to:

• Hookah devices in various sizes and styles
• Hoses and mouthpieces
• Coal trays and other necessary accessories
• A variety of tobacco flavors and alternatives

By using our services, Customers agree to be responsible for the safe and proper use of the Equipment during the rental period.

4. Ordering and Advance Notice Requirements

All Orders must be placed in advance, with specific notice periods depending on the number of hookah devices being rented. The required notice is as follows:

For bulk Orders (6 or more hookah devices), a refundable Security Deposit equal to 50% of the total invoice amount is required, to be paid at least 3 days before delivery.

5. Payment Terms

Payments must be made in full before the dispatch of Equipment. Accepted payment methods include electronic funds transfers (EFT), credit/debit cards, and other payment methods specified on our website. Customers are responsible for ensuring timely payment. Failure to make payment may result in cancellation of the Order.

6. Delivery and Collection Policy

Rent A Hubbly utilizes third-party drivers for delivery and collection of Equipment. Customers must provide accurate delivery details, including their name, email address, phone number, number of days for rental, number of hookahs, delivery address, and desired delivery time.

Customers must be available to receive the Equipment at the agreed-upon delivery time. If the Customer is unavailable and the driver is required to wait more than 5 minutes after at least three attempts to reach the Customer, a penalty of R200 plus 50% of the delivery fee will apply.

Upon receiving the delivery, Customers must specify a collection time. The Equipment must be returned by 2 PM the following day to avoid late fees. Failure to return the Equipment by the specified time will result in the following fees:

• Late return before 2 PM: R200
• Late return after 2 PM and before 5 PM: R500

7. Refund and Cancellation Policy

Rent A Hubbly has the following refund and cancellation policies:

• Regular Orders: For regular orders, Customers can cancel their Order without penalty up until the Equipment has been dispatched. All cancellations carry a 10% cancellation fee.

• Event Orders: A sliding scale cancellation fee applies based on the notice provided:

  • More than 7 days: 10% of the total cost
  • Between 3 and 7 days: 25% of the total cost
  • Between 24 and 72 hours: 50% of the total cost
  • Less than 24 hours: No refund will be issued.

Refunds for any cancellations or failures to deliver will be processed within 3 business days.

8. Security Deposits and Liability for Damages

For bulk Orders (6 or more hookah devices), a refundable Security Deposit of 50% of the total invoice amount is required. The Security Deposit will be refunded within 5 business days of the safe return of the Equipment, following inspection for damages.

Customers must report any loss or damage to the Equipment within 15 minutes of receipt. If reported after this time, the Customer assumes full liability for any damage or loss. Should the Customer fail to return a full hookah device with associated accessories, the Customer will be liable for a fee of R2,800.

Customers are responsible for any damage or loss incurred during the rental period, whether due to their own actions or those of the third-party driver. Rent A Hubbly will make claims against third parties if the loss or damage is caused by the driver.

9. Customer Conduct and Dispute Resolution

Customers are expected to treat Rent A Hubbly staff, drivers, and other personnel with respect. Rent A Hubbly reserves the right to refuse service to any Customer exhibiting rude, aggressive, or abusive behavior. In such cases, Rent A Hubbly may terminate the rental agreement without refund.

If any disputes arise, Customers are encouraged to resolve these issues privately with Rent A Hubbly. The Company operates in good faith and aims to address any concerns amicably. If a dispute cannot be resolved through direct communication, Customers may seek mediation or other low-cost dispute resolution methods that do not incur travel costs.

10. Health Disclaimer

Rent A Hubbly is not liable for any health issues that may arise from the use of the Equipment. Hookah smoking poses various health risks, and Customers are solely responsible for the use of the Equipment at their own risk.

11. Limitation of Liability

Rent A Hubbly shall not be liable for any injury, loss, or damage arising from the use or misuse of the rented Equipment. Customers assume full responsibility for the safe operation and care of the Equipment during the rental period.

In the event that a Customer claims damages from Rent A Hubbly, the Company’s liability is limited to the amount paid by the Customer for the rental of the Equipment in question.

12. Intellectual Property Rights

All intellectual property rights associated with Rent A Hubbly and its services, including trademarks, logos, and any content created by or for Rent A Hubbly, are owned and controlled by Pine Street Capital Management (Pty) Ltd. Customers acknowledge that they have no rights to any such intellectual property and agree not to use it without prior written consent from Rent A Hubbly.

Customers grant Rent A Hubbly the right to use any content, images, or testimonials shared by them for marketing purposes, in both South Africa and globally, across all platforms.

13. Privacy and Data Protection

Rent A Hubbly respects your privacy and is committed to protecting your personal information. We may collect personal information such as your name, email address, phone number, delivery address, and rental details for order processing, marketing, and business analysis purposes.

We comply with the Protection of Personal Information Act (POPIA) in South Africa and will only use your personal information in accordance with our Privacy Policy. Customers have the right to request access to their personal information and request corrections as needed.

14. Amendments to Terms

Rent A Hubbly reserves the right to amend these Terms at any time. If we make changes, we will notify Customers via email or through our website. Continued use of our services after the amendment date constitutes acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of South Africa. Any disputes arising under or related to these Terms will be subject to the exclusive jurisdiction of the courts of South Africa.
